LetzMark (“we”, “our”, “the App”) values your privacy. This Privacy Policy explains how we collect, use, store, and protect your information when you use our mobile app and website. By using LetzMark, you agree to this Privacy Policy.

1. Profiles and Account Data

You can create multiple local profiles on your device. Offline profiles exist independently and do not transmit personal data. When you link a profile to an online account, we collect and store information such as email, password (encrypted), nickname, avatar, handle/identifier, and technical data required to provide cloud, social, and subscription features.

2. Collections and Item Data

Collections can contain various types of items, including multimedia (images, videos, audio, text), shapes, routes, areas, and future-supported types. Each item can optionally have geolocation data; paths and areas may have multiple geolocation points. Collections stored locally on your device are not transmitted unless published to the cloud. If you publish a collection, we store the content, geolocation, and associated metadata in our cloud servers.

3. Collaborative Collections

Collections can be shared with specific users, groups, via temporary access tokens, or as collaborative collections. In collaborative collections, multiple users may view or edit content. Data shared in collaborative collections (content, edits, comments) is visible to other participants. Collection owners retain ownership and may moderate or remove contributions by collaborators.

4. Social Interactions and Notifications

We collect and store information about user interactions, including comments, replies, mentions, stars, follows, and activity on collection items. Notifications are generated for actions such as mentions, replies, comments, and collection updates. This data is used solely to provide social features, notifications, and related app functionality.

5. Location-Based Features

Location-based features are fully opt-in and activated per collection via a "Start Tour" button or similar action. When a tour is active, we may process your real-time location to provide alerts, notifications, media playback, or off-route guidance. Location data is only collected while a tour is active and is immediately stopped if the tour is canceled. You are responsible for your own safety when using location-based features.

6. Cloud Storage and Data Retention

Data uploaded to cloud storage, including collections, collaborative edits, comments, and notifications, is stored securely. We retain your data as long as your account exists or according to applicable legal obligations. You can delete your account or collections, which removes your data from cloud servers, subject to retention for legal or operational purposes.

7. Security

We implement reasonable technical and organizational measures to protect your data. Passwords are stored encrypted. While we strive to protect your information, no system is completely secure. You are responsible for maintaining the confidentiality of your account credentials.

8. User Responsibilities

You are responsible for the content you upload or share, including collections and comments. You must not upload illegal, offensive, plagiarized, or harmful content. Misuse may result in suspension, removal of content, or account termination.

9. Premium Subscriptions and Tips

We collect information necessary to manage subscriptions, payments, and tips. Payment processing is handled by the app store; we do not store your payment details. Tips may be linked to your profile for cosmetic badges only.

10. Third-Party Services

LetzMark uses third-party services to provide analytics, email verification, cloud storage, map functionality, and subscription management. We only share the minimum data required for these services to function. Examples of shared data include:

• Email addresses for account verification and notifications.
• Content uploaded to the cloud for storage and delivery.
• Device and app usage information for analytics and subscription management.
• Map requests or search queries for map display and search functionality.
• Payment processing information handled by the app stores; we do not store payment details.

Where personal data is processed by third parties, we ensure appropriate data processing agreements or privacy protections are in place. Uploaded content may be cached or distributed globally to improve performance.

11. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in the App or legal requirements. The latest version will be posted within the App and on our website. Continued use of the App constitutes acceptance of the updated Privacy Policy.

12. Governing Law

This Privacy Policy is governed by the laws of the Czech Republic. Any disputes related to this policy or your data will be subject to the jurisdiction of Czech courts.
