Terms of Service

Welcome to LetzMark (“we”, “our”, “the App”). By accessing or using the App, you agree to comply with these Terms of Service (“Terms”). Please read them carefully. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years old to create an account and use LetzMark. By registering, you confirm that you meet this age requirement. Use of the App by minors under 13 is strictly prohibited.

2. Account Registration and Security

To use certain online features of LetzMark, you must create an online account with a valid email and password. Online account can be linked to one of your local profiles. Offline profiles exist independently and do not require an online account, but linking a profile unlocks cloud storage, sharing, social interactions, collaborative collections, notifications, and subscription features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and keep it updated. Any unauthorized use of your account must be reported immediately.

3. Profiles and Collections

In LetzMark, you can create multiple local profiles on your device. These profiles function independently and allow you to organize your collections offline. Each profile can contain collections composed of various items, including multimedia content (such as images, videos, audio, or text), shapes, routes, areas, or other types of content that may be supported in the future. Each item can optionally have geolocation data, allowing it to be placed on a map. In the case of paths or areas, a single item may contain multiple geolocation points to define routes, boundaries, or regions. Collections can be stored locally on your device or published to cloud storage. By default, collections are private, but you may choose to share them publicly, with specific users, via temporary access tokens, or as collaborative collections where multiple users may view or edit content with your consent.

4. User-Generated Content

You are solely responsible for all content you upload, post, or share within LetzMark. You may not upload content that is illegal, offensive, vulgar, plagiarized, commercial advertising, or otherwise violates applicable laws or our rules. Collection owners may moderate comments and contributions on their collections, including content added by collaborators. The App reserves the right to remove content at our discretion, without prior notice. Repeated violations may result in temporary suspension or permanent termination of your account. We are not responsible for user-generated content or the actions of other users.

5. Social Interactions

LetzMark allows users to interact socially through comments, replies, mentions, stars, follows, and notifications. Notifications may be triggered by activity on collections or individual items within collections. You may delete your own comments at any time. Collection owners may moderate all comments and contributions on their collections. Misuse of these features, including harassment or spamming other users, may result in restrictions or account termination.

6. Location-Based Features

LetzMark offers location-based functionality that can be activated per collection via a "Start Tour" button or similar action. Location tracking and notifications only occur after the user starts a tour. While a tour is active, the App may use your real-time location to trigger alerts, notifications, media playback (such as audio), or guidance if you move off a designated path. You are responsible for your own safety when using tour features. You can stop or cancel a tour at any time, which will immediately deactivate location tracking and notifications. Location data is only used for these features while a tour is active.

7. Sharing and Collaboration

You control access to your collections. Sharing may be done publicly, via access tokens, or with specific users or groups. Collaborative collections allow multiple users to view or edit content with your consent. Participants in collaborative collections must comply with these Terms, and collection owners may moderate or remove content contributed by collaborators. Sharing access does not transfer ownership of your content.

8. Premium Subscriptions and Tips

LetzMark offers free and premium subscription plans. Premium subscriptions provide additional cloud storage, map features, and enhanced app limits. All subscriptions are billed via the relevant app store (Apple or Google) and are subject to their terms. You may cancel subscriptions at any time through the app store. Tips are optional one-time payments that provide cosmetic badges but do not grant additional features or privileges. Refunds and billing inquiries are handled according to app store policies.

9. Prohibited Conduct

When using LetzMark, you may not: upload illegal content, post offensive or harmful material, share content in violation of copyright, use the App to advertise commercial services, attempt to steal or bypass moderation of deleted content, interfere with the App’s functionality, or harass other users. Violations may result in account suspension or termination.

10. Account Termination and Suspension

LetzMark reserves the right to suspend or terminate accounts at any time for violations of these Terms or applicable laws. Termination may result in permanent loss of access to your collections, social interactions, and account. Users may delete their accounts at any time through the app, subject to retention policies necessary for legal or operational purposes.

11. Intellectual Property

All content you upload remains your property. By using the App, you grant LetzMark a limited license to store, display, and distribute your content according to your sharing and collaboration settings. LetzMark retains all rights to the software, trademarks, and services provided by the App.

12. Disclaimers and Limitation of Liability

The App is provided “as-is” without warranties of any kind. We are not responsible for user-generated content, interactions, or the actions of other users. We are not liable for damages, including data loss or financial loss, arising from the use of the App. If a technical issue or data breach occurs, we will notify users promptly but are not liable for resulting damages.

13. Changes to the Terms

We may update these Terms to reflect changes in the App or legal requirements. The latest version will be posted within the App and on our website. Continued use of the App constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the Czech Republic. Any disputes arising from these Terms or your use of LetzMark will be subject to the jurisdiction of Czech courts.
